RE-Sounding Woman Retreats Attendee Agreement (Overnight Guests)

This Service Agreement ("Agreement") is made and entered into by the undersigned parties ~ You, (the “Client”) located at the address listed below, and Elise Besler-Harnish (the “Coach/Consultant”) located at 1409 Purcells Cove Road, Halifax NS B3P1B3

The Client will be attending the 2 day RE-Sounding Woman Retreat, Ingramport Nova Scotia April 19th-20th, 2024 (the “Program” or “Services”) hosted by Coach/Consultant Elise Besler-Harnish.

If the Client does not agree to these terms, please reach out to Elise and Team via email at hello@elisebesler.com before registering and attending the RE-Sounding Woman Retreat.
PLEASE READ THROUGH THE FOLLOWING AGREEMENT CAREFULLY BEFORE CONFIRMING YOUR ATTENDANCE AT THIS RETREAT.

1. WHAT’S INCLUDED (“Services”)
Your retreat includes:

✸ Daily voice confidence, voice empowerment and nervous system regulation retreat programming and coaching/consulting with Elise Besler of EB Voice Empowerment

✸ Detailed daily itinerary

✸ Welcome gift

✸ 2 fully catered lunches

✸ 1 fully catered dinner (Saturday Evening)

✸ All snacks and tea/coffee/sparkling water

✸ Daily sound healing and somatic practices

✸ Nervous system regulating practices

✸ Access to all property amenities (including indoor saltwater pool)

Your retreat does not include:

✸Travel to and from the retreat centre, including flights if coming from outside of Nova Scotia

✸ Any alcohol you wish to consume outside of retreat programming.

✸ Any specialized snacks or food items you need for medical reasons

A Note About Travel Insurance: We strongly advise you speak with a travel insurance provider about purchasing travel cancellation and interruption insurance, and coverage in the event that you get ill and can’t attend, as there are no refunds once registered.

BACKGROUND and QUALIFICATIONS

A. The Client is of the opinion and trusts that the Consultant has the necessary qualifications, experience, and abilities to provide services to the Client.

B. The Consultant is agreeable to providing such services to the Client on the terms and conditions set out in this Agreement.

IN CONSIDERATION OF the matters described above and of the mutual benefits and obligations set forth in this Agreement, the receipt and sufficiency of which consideration is hereby acknowledged, the Client and the Consultant (individually the "Party" and collectively the "Parties" to this Agreement) agree as follows:

1. Term

The term of this Agreement (the "Term") Agreement shall begin on April 18th, 2024, and will remain in full force and effect until April 21st, 2024.

2. Services

The Consultant will provide Services to the Client as described above.

The Service provided to the Client by the Consultant is voice confidence, visibility, nervous system health and somatic wisdom mentoring/consulting, which is not directive medical advice, counselling, or therapy. It may address overall goals, specific projects, or general conditions in the Client's life or profession but cannot replace or substitute for the services of trained professionals in any field, including, but not limited to, psychological, financial, medical, or other matters.

3. Performance

The Parties agree to do everything necessary to ensure that the terms of this Agreement take effect.

4. Compensation

All monetary amounts referred to in this Agreement are in CAD .

The client will pay a total of $795 in _______ installment of ______ with initial deposit being due upon execution of this contract, and the remaining due every 30 days until full payment is received.

15% HST will be added to the Retreat price upon payment.

A Late Fee of $50 CAD will be applied to any invoices which are more than 5 days overdue. If a payment extension is required, please communicate this clearly within 5 days of payment due date.

Refund Policy: The policy is that once the payment by the Client is made to the Consultant, there are no refunds. However, if the Consultant is unable to host the retreat due to any health or other emergency, the retreat will be rescheduled to a later date. If the Client is unable to attend the new date, a full refund will be issued.

6. Confidentiality

The Consultant agrees that they will not disclose, divulge, reveal, report or use, for any purpose, any Confidential Information which the client shares during the Retreat.

The Client agrees that they will not disclose, divulge, revel, report or use , for any purpose, any Confidential Information which fellow attendees share during the Retreat.

7. Retreat Courtesy and Communication

The Client agrees to the following during The Retreat:

✸ To refrain from cross talking in coaching circles.

✸ To refrain from cross coaching or giving unsolicited advice in coaching circles.

✸ It goes without saying; the RE-Sounding Woman Retreat is a place of bravery and inclusivity. The Client holds the shared values of diversity, equity, and inclusion in matters of race, religion, body size, sexual orientation, or other marginalizing factors. It is understood that if any racist, size-ist, homophobic, transphobic or other marginalizing slurs, actions or communication takes place during the Retreat, the Consultant reserves the right to ask the Client to leave, without compensation or refund.

✸ To clearly communicate any important needs or concerns to Elise and Team BEFORE and DURING The Retreat

✸ To keep personal safety front of mind in matters of recreational alcohol use, swimming, time spent in nature and on retreat property grounds.


7. Intellectual Property

The Client agrees to cite any of the Consultant’s work, exercises or inspiration, should the Client choose to use any materials or exercises in their own body of work.

8. Limitation of Liability

It is understood and agreed that the Consultant will not be liable to the Client, or any agent or associate of the Client, for any mistake or error in judgment or for any act or omission done in good faith and believed to be within the scope of authority conferred or implied by this Agreement.

9. Entire Agreement

This Agreement represents the entire agreement between the parties and the provisions of this Agreement shall supersede all prior oral and written commitments, contracts, and understandings with respect to the subject matter of this Agreement. This Agreement may be amended only by mutual written agreement of the Parties.

10 .Governing Law and Principles of Construction

This Agreement shall be governed and construed in accordance with Nova Scotia law. If any provision in this Agreement is declared illegal or unenforceable, the provision will become void, leaving the remainder of this Agreement in full force and effect.

IN WITNESS WHEREOF, the parties hereto have caused this Agreement to be executed by their duly authorized representatives, effective as of the day and year first above written. By e-signing this document, all points are agreed upon.
